(a) Council does hereby approve, adopt and intends to implement the City Industrial Waste Pretreatment Program report dated September, 1984, by Frank A. Thomas & Associates, Inc., Consulting Engineers, as completed in accordance with Public Law 95-217, the Federal Clean Water Act of December, 1977, General Pretreatment Regulations 40 CFR 403, 1978, as per agreement between the City and Frank A. Thomas & Associates, Inc., Consulting Engineers.
(b) The report concludes that the Federal and State laws mandate the implementation of an industrial pretreatment program and recommends the City enforce the Sewer Use Ordinance as the vehicle for achieving quantifiable improvements in the quality of industrial discharges that would otherwise be detrimental to the City Wastewater Treatment Plant operations and sludge disposal management system.
(c) This chapter is hereby declared to be an emergency, the emergency being the immediate need to satisfy the requirements of the U.S. EPA, the Ohio EPA and Public Law 92-500 as applied to publicly owned treatment works (POTW), all for the health, welfare and safety of the residents of Fremont, wherefore, this chapter shall take effect and be in force immediately upon its passage and approval by Council provided it meets the statutory requirements for passage, otherwise it will take effect and be in force from and after the earliest period allowed by law.
