(a) The conditional encroachment approval process shall consist of the following steps:
(1) Submission of a completed application, materials, and fees to the Safety Service Director.
(2) Approval by City Council by ordinance.
(3) Recording of said ordinance in the office of the Recorder’s Office of Sandusky County, Ohio.
(b) Applications for conditional encroachment approval shall be obtained from the office of the Safety Service Director and when completed shall be returned to that office. The application shall consist of the completed form; a boundary survey completed by a registered surveyor; and a complete legal description of the land upon which the encroaching building or structure lies.
(c) Upon receipt of the application the Safety Service Director shall transmit the completed application to the Clerk of Council within five working days.
(d) Council shall approve or deny the application within forty-five days after receipt thereof by the Clerk of Council.
(e) Any encroachment approval granted by Council shall terminate upon the demolition, removal or destruction of said encroaching building or structure, whether intentional or otherwise.
(f) No renovations or repairs to an encroaching building or structure may be commenced, other than for ordinary maintenance without the written permission of the Safety Service Director.
