(a) No person shall plant any tree or shrub upon any public way, street or alley unless he has first obtained permission in writing from the Safety Service Director specifying the size, type, species and location on the public way, street or alley of the tree or shrub to be planted.
(b) The Safety Service Director shall have the authority to refuse permission to any person to plant upon a public way, street or alley any tree or shrub found by the Tree and Beautification Commission to be undesirable as to size, type or species or for the proposed planting location. The Safety Service Director may also refuse permission to any person to plant upon a public way, street or alley any tree or shrub, if it is determined that the proposed location is not suitable for the planting of tree or shrubs.
