§ 97.57  REPAIR OF UNDERGROUND UTILITIES.
   The repair of utilities located underneath the streets, alleys, and in the right-of-way within the city shall be as follows:
   (A)   All utility companies, or other persons making repairs or improvements within the street, alley, or right-of-way owned by the city, shall comply with this chapter, unless otherwise excepted.
   (B)   Emergency cuts and repairs by utilities, or other authorized persons within the right-of-way of the city streets and alleys, shall be made as follows:
      (1)   Necessary repairs may be instituted after work hours and on holidays and weekends by:
         (a)   Advising the City Police Depart- ment prior to beginning repairs.
         (b)   Exercising safety provisions as outlined in this code of ordinances and other applicable laws and regulations as to the type, manner, and method of repair and protection of the workers, traffic, and pedestrians.
         (c)   Backfilling all cuts and excavations with proper sand and/or limestone mixtures for existing conditions prior to inspection by the city.
         (d)   Apply for a permit for the emergency repairs by 10:00 a.m. on the next city workday which is not a Saturday, Sunday, or holiday.
         (e)   Complete repairs pursuant to this chapter.
      (2)   All concrete cuts shall be squared up by concrete saw prior to repaving and repairing of the street and/or curb.
      (3)   When emergency repairs are required and provided by the utility or person making same, all bond, safety, warranty, and other conditions contained in this chapter, being the responsibility of the using or repairing entity, are and shall be in full force and effect; and this emergency repair provision is and shall be a temporary emergency waiver of permit requirements only until the city offices are regularly open for business.
   (C)   Any residential sewer line, being positioned below a city street with service connections to the household located under these streets, will be repaired and maintained by the city from the curbline or pavement edge forward to the main sewer line. This policy does not include or apply to alleys or other areas.
   (D)   It shall be unlawful for any person or utility to violate a provision of this section and each day’s violation shall be a separate offense.
