§ 97.50  CONDITIONS OF PERMIT.
   (A)   Every permit for any excavation in or under the surface of any street, alley, sidewalk, or other public place shall be granted subject to the right of the city, or of any other person entitled thereto to use that part of such street, alley, sidewalk, or other public place for any purpose for which the same may be lawfully used.
   (B)   The granting of any permit hereunder, for the purpose of locating or placing any pipe, conduit, duct, tunnel, or other structure shall not be construed to grant to such person any fixed or vested right in such location, but all the same shall be taken to the right of the city or of any other person entitled thereto, to lay or place its pipe or pipes, conduit, or other structures in or under such portion thereof under or across such pipe, conduit, duct, or other structure as may have been laid, without cost or charge being exacted by the installer at the prior location for which used.
   (C)   All persons receiving permits to put or place pipes, conduits, ducts, or other structures under the surface of any public street, alley, sidewalk, or other public place in the city thereby obligate and bind themselves to move or change the location of their pipes, conduits, ducts, or other structures whenever ordered or instructed to do so by the city, and failure to do so, or interfering with any other person in the matter of moving the pipe, conduit, or other structure under any street, alley, sidewalk, or other public place shall constitute an offense.
