§ 95.06  FUEL STORED ON VESSELS; AFFIRMATIVE DEFENSE.
   (A)   No flammable liquids and no combustible liquids used or to be used for fueling any vessel shall be stored on such vessel in containers larger than 15 gallons while such vessel is docked in any navigable artificial waterway adjacent to any premises within a subdivision located adjacent to such navigable artificial waterway other than a marine service station.
   (B)   It is an affirmative defense to a violation of division (A) of this section if:
      (1)   All fuel which is stored on such vessel is stored in the fuel tank of such vessel; and,
      (2)   Such fuel tank is no larger than the fuel tank with which a commercially manufactured vessel of equivalent size is designed to be equipped by the manufacturer of such vessel.
