270.09   CIVIL RIGHTS IN PLACES OF PUBLIC ACCOMMODATION.
   (a)   Definitions. The following definitions are applicable strictly in the context of this section. In addition to the definitions provided in this section, the definitions contained in Section 270.08(b) are hereby incorporated by reference for use in this section.
      (1)   "Operator" means any owner, lessee, proprietor, manager, superintendent, agent or occupant of a place of public accommodation, or an employee of any such person or persons.
      (2)   "Place of accommodation" means a business, accommodation, refreshment, entertainment, recreation or transportation facility of any kind, whether licensed or not, the goods, services, facilities, privileges, advantages or accommodations of which are extended, offered, sold or otherwise made available to the public. "Places of accommodation" include the facilities of, but are not limited to:
         A.   Inns;
         B.   Restaurants;
         C.   Eating houses;
         D.   Hotels and motels;
         E.   Soda fountains;
         F.   Soft drink parlors;
         G.   Taverns;
         H.   Roadhouses;
         I.   Barber shops;
         J.   Department stores;
         K.   Clothing stores;
         L.   Hat stores;
         M.   Shoe stores;
         N.   Bathrooms;
         O.   Restrooms;
         P.   Theatres;
         Q.   Skating rinks;
         R.   Public golf courses;
         S.   Public golf driving ranges;
         T.   Concerts;
         U.   Cafes;
         V.   Bicycle rinks;
         W.   Elevators;
         X.   Ice cream parlors or rooms;
         Y.   Railroads;
         Z.   Omnibuses;
         AA.   Buses;
         BB.   Trolleys;
         CC.   Stages;
         DD.   Airplanes;
         EE.   Street cars;
         FF.   Boats;
         GG.   Funeral hearses;
         HH.   Crematories;
         II.   Cemeteries;
         JJ.   Public conveyances on land, water or air;
         KK.   Public swimming pools; and
         LL.   Other places of public accommodation and/or amusement.
   (b)   Civil Rights Violations. It is a civil rights violation on the basis of unlawful discrimination for:
      (1)   Any person to deny or refuse to another person the full and equal enjoyment of facilities and services of any public place of accommodation; or
      (2)   The operator of a place of public accommodation to directly or indirectly publish, circulate, display or mail any written communication which the operator knows is to the effect that any of the facilities of the place of public accommodation will be denied to any person or that any person is unwelcome, objectionable or unacceptable because of unlawful discrimination.
   (c)   Exemptions. Nothing in this section shall apply to:
      (1)   A facility, in regard to discrimination based upon sex, which is distinctly private in nature, such as a restroom, shower room, bath house, health club or other similar facility for which the Illinois Department of Human Rights or the City Human Relations Commission, in their rules or regulations, may grant exemptions based upon bona fide considerations of public policy; or
      (2)   A facility, in regard to discrimination based upon sex, which restricts the rental of rooms to individuals of one sex.
