(a) Discriminatory Terms, Conditions or Privileges. It shall be an unlawful housing practice and a violation of this chapter for any owner or other person to sell or lease real property on terms, conditions or privileges that discriminate between persons because of race, color, ancestry, national origin, religion, sex (including sexual harassment), pregnancy, age (40 and over), order of protection status, marital status, sexual orientation (including gender-related identity), military status, unfavorable military discharge, disability, arrest record, familial status, citizenship status and source of income.
(b) Refusals to Negotiate. It shall be an unlawful real estate practice and a violation of this chapter for any owner or other person to refuse to negotiate for, enter into or perform any sale or lease of any real property because of the race, color, ancestry, national origin, religion, sex (including sexual harassment), pregnancy, age (40 and over), order of protection status, marital status, sexual orientation (including gender-related identity), military status, unfavorable military discharge, disability, arrest record, familial status, citizenship status and source of income of any party to such sale or lease, of any member of the family of any such party, of any person using or occupying, or intending to use or occupy, such real property or of any person using or occupying any real property in the area in which such real property is located.
(c) Withholding of Housing. It shall be an unlawful real estate practice and a violation of this chapter for any owner or other person to represent to any person that any real property is not available for inspection, purchase, sale, lease or occupancy when in fact it is so available, or otherwise to withhold real property from any person because of race, color, ancestry, national origin, religion, sex (including sexual harassment), pregnancy, age (40 and over), order of protection status, marital status, sexual orientation (including gender-related identity), military status, unfavorable military discharge, disability, arrest record, familial status, citizenship status and source of income.
(d) Unlawful Advertisements. It shall be an unlawful real estate practice and a violation of this chapter for any owner or other person to publish or circulate a statement, advertisement or notice of an intention to sell or lease any real property in a manner that is unlawful under this chapter, or to consent thereto.
(e) Unlawful Signs and Notices. It shall be an unlawful real estate practice and a violation of this chapter for any owner or other person to post or erect, or cause any person to post or erect, any sign or notice upon any real property indicating an intent to sell or lease any real property in a manner that is unlawful under this chapter.
(f) Limitations; Exceptions. Nothing in this chapter shall require an owner to offer real property to the public at large before selling or renting it, provided that he or she complies with all other provisions of this chapter, require an owner or his or her agent to offer real property for sale or lease to any person if the owner or his or her agent has reasonable cause, which can be substantiated, to believe that such person is not negotiating for the purchase or lease of such real property in good faith, or prohibit owners from giving preference to prospective tenants or buyers for any reason other than race, color, ancestry, national origin, religion, sex (including sexual harassment), pregnancy, age (40 and over), order of protection status, marital status, sexual orientation (including gender-related identity), military status, unfavorable military discharge, disability, arrest record, familial status, citizenship status and source of income.
