(a) Generally. Any person seeking review (the "Applicant") of:
(1) A Preliminary Plat or Final Plat under Chapters 1224;
(2) A Planned Development pursuant to Chapter 1264;
(3) A Condominium Plat pursuant to Chapter 1484; or
(4) Any other site plan which the Director of Community Development or the Director of Public Works believe, in their sole but reasonably exercised discretion, will require engineering review prior to the issuance of any permit required by the City;
shall be required to deposit review fees with the City as set forth in this section at the time of the application is for review is submitted. The Finance Department shall promptly cause such fees to be deposited in the City's General Corporate Fund.
(b) Review Fees Payable at Time of Filing. A filing and processing fee of $500.00 shall be payable at the time of filing of any Plat or Site Plan described under subsection (a) of this section. Upon receipt of such filing, a written estimate shall be requested from the City's engineer for review services, and shall be provided to the applicant upon receipt by the City. The applicant shall be required to deposit with the City an amount equal to 125.00% of the estimate. Upon receipt of the invoice and after final disposition of the application, whether or not granted, the amounts held by the City pursuant to this section shall be applied to the invoice, and the balance, if any, shall be returned to the applicant.
(c) Publication Costs. Unless otherwise expressly provided for by another provision of these Codified Ordinances, any actual required publication costs and mailing costs for public notice shall be paid by the applicant at the time of filing any application for review.
(d) Fees Non-Exclusive. The fees set forth in this section are not exclusive, and all applicable fees shall be paid, irrespective of whether another fee has been paid for the same project. By way of example and not limitation, an applicant may be required to pay a Preliminary Plat Fee, a Final Plat Fee, and an Infrastructure Inspection Fee on the same project.
(e) Payment Required Prior to Consideration. Unless all fees required by this section, and any other applicable section of these Codified Ordinances are paid in full, no Plat, Plan, or other project shall be submitted to the Board, Council, Committee charged with conducting a public hearing, or to any public official having the authority to approve or disapprove a project without a public hearing.
