(a) Permit Required. Without first obtaining a permit from the Director of Public Works, no person shall:
(1) Construct a new driveway approach;
(2) Reconstruct a driveway approach; or
(3) If no longer appropriate or suitable for the use:
A. Continue to use an existing driveway approach when the zoning classification of the corresponding property has changed;
B. Continue to use an existing driveway approach after internal site reconfiguration substantially changes the volume or intensity of traffic using the driveway; or
C. Continue to use an existing driveway approach, after the volume, intensity or type of traffic using the driveway has substantially changed.
For purposes of this section a "driveway approach" shall constitute that portion of any driveway which is located in the public way, or otherwise connects to a public way for purposes of ingress and egress to any property located with the City. "Driveway sidewalk" shall refer to any sidewalk located in a public way which crosses a driveway or driveway approach.
(b) All work shall comply with established standards and specifications on file with the Department of Public Works, the applicable provisions of these Codified Ordinances, including, but not limited to the provisions of this Title Two, as well as applicable standards for driveway approaches imposed by the Illinois Department of Transportation, or otherwise required to comply with current Public Right-of-Way Accessibility Guidelines (PROWAG) standards as published from time to time by the U.S. Access Board.
