824.03 REQUIREMENTS FOR LICENSURE.
   No license shall be issued for the operation of a community reintegration facility unless the requirements of this section are first met:
   (a)   Inspections Required. The following inspections shall be completed and submitted with the permit application:
      (1)   An inspection report from the City Building Inspector indicating that the structure in which the community reintegration facility is located complies with all applicable provisions of the Building and Housing Code of the City of Freeport (for purposes of Code compliance only, a community reintegration facility may be deemed a rooming house or other similar facility based upon actual usage);
      (2)   A health inspection report from the Stephenson County Department of Public Health stating that the community reintegration facility complies with applicable State and county public health statutes, laws and regulations.
   (b)   Prohibited Persons. No license may be issued to:
      (1)   A person who is not a resident of Stephenson County, Illinois;
      (2)   A person who is not of good character and reputation in the community;
      (3)   A person who is not a citizen of the United States;
      (4)   A person who has been convicted of a felony offense under Federal or State Law;
      (5)   A person whose license issued under this chapter has been revoked for cause;
      (6)   A person who at the time of application for renewal of a license hereunder would not be eligible for such a license on first application;
      (7)   Any business entity, including, but not limited to, a corporation, limited liability company or partnership, in which more than five percent of the ownership or control of the entity is held by any person who would not qualify for licensure in his or her own person for any reason other than residency within Stephenson County;
      (8)   Any business entity, or natural person whose business is conducted by an agent, unless managed by a person who meets all requirements of a licensee hereunder, including the residency requirement; or
      (9)   A person who does not own the premises at which the licensed facility will be located and does not have a lease for the premises for the entire term of the license.
   (c)   Application for License. The application for licensure shall include, at a minimum.
      (1)   The names and addresses of the persons responsible for operation of the facility. At a minimum, the name of the owner of the property on which the community reintegration facility is to be located shall be provided, along with the name, address, and telephone contact information for the on-site supervisor or manager of the facility, if different.
      (2)   A statement as to whether the facility will be operated as a:
         A.   Community reintegration facility, substance abuse;
         B.   Community reintegration facility, ex-offender; or
      (3)   Proof of proper zoning for the requested use.
