806.19 DELIVERY OF ALCOHOLIC BEVERAGES.
   Delivery of alcoholic beverages to any location within the City shall be in strict accordance with the provisions of this section. For purposes of this section the term "delivery" shall be deemed only to reference the delivery of alcoholic beverages, and shall encompass all transactions in which alcoholic beverages are delivered to persons not on the licensed premises, even if delivery occurs on property otherwise owned by the licensee.
   (a)   Delivery of alcoholic beverages may be made by any existing licensee, so long as delivery is made in strict accordance with the requirements of this section. Any non-licensee carrier shall be required to obtain a permit in accordance with Section 806.20 and to comply with all of the requirements of this section, and for all purposes of this section, the term "licensee" shall be deemed to include all non-licensees who have obtained such permit.
   (b)   Delivery of shall be made only during permitted hours of sale of alcoholic beverages. For purposes of this section the actual time of sale shall not be considered, but rather the time of actual transfer of possession to the purchaser shall be considered the time of delivery.
   (c)   Delivery shall be made only by BASSETT trained employees of a licensee who are twenty-one years of age or older.
   (d)   Deliveries shall be made only to persons who are twenty-one years of age or older. The licensee or permittee shall require adequate proof of age at the time of delivery. At a minimum, the licensee shall require that the person accepting any delivery provide one form of identification containing proof of age, with a photograph, issued by a public officer in the performance of his or her official duties.
   (e)   A record shall be kept by the licensee with respect to every delivery, indicating, at a minimum:
      (1)   The name, address, and driver's license/state identification number of the person accepting the delivery;
      (2)   The time and date of delivery;
      (3)   The location of the delivery; and
      (4)   The identity of the person making the delivery.
      A time-stamped digital photograph of an identification meeting the requirements of subsection (d) of this section shall suffice to satisfy the requirements of subparagraphs (1) and (2) of this subsection (e). Deliveries made to persons on property owned by a licensee, in an area specifically designated for pick-up or deliveries, in connection with an online order or other electronic means of presale, need not comply with the provisions of this subsection, so long as all of the remaining requirements of this section are met, and a surveillance camera, meeting the requirements of Section 874.13 is installed in a way which provides a clear view of the point of delivery.
   (f)   No delivery shall be made to any address unless a qualified person is present to accept the delivery. No delivery shall be left unattended on any property.
   Notwithstanding anything to the contrary contained herein, this section shall not be deemed to prohibit the delivery by common carriers of alcoholic liquor lawfully shipped through means of interstate commerce. By way of example, and not limitation, delivery by the U.S. Postal Service, FedEx, United Parcel Service, DHL, and other similar interstate carriers is not prohibited by this section.
