1032.03   CONSTRUCTION AND REPAIR.
   (a)   Compliance. All multi-use paths hereafter constructed or repaired on or along any street within the City, whether pursuant to any special ordinance or otherwise, shall, unless otherwise provided by special ordinance, be constructed or repaired as herein provided.
   (b)   Location. All multi-use paths hereafter constructed for public use shall be upon such portion of the land between the curb line of the street and the property line of the abutting owner, within a designated easement, or on property owned by a unit of government, as shall be particularly designated by the Public Works Director or City Engineer and approved by the Corporate Authorities of the City. All easements shall be permanent or for a lease period of no less than twenty years.
   (c)   Width Line and Grade. The width, line and grade of all multi-use paths hereafter constructed shall be determined by the Public Works Director or City Engineer, and there shall be no variation from his or her determinations and directions in such mailers unless so ordered by vote of the Corporate Authorities of the City. All pavements shall comply with all State and local laws for accessibility at the time of construction and shall not exceed a two-percent cross-slope. All multi-use paths shall be a minimum width of eight feet.
   (d)   Materials and Specifications. All multi-use paths, unless otherwise provided by special ordinance, shall be constructed or repaired with hot-mix asphalt or Portland cement concrete in accordance with the Standard Specifications for Road and Bridge Construction of the Illinois Department of Transportation, latest addition, along with the following requirements:
      (1)   Hot-mix asphalt multi-use paths shall be constructed on a minimum base course of eight inches with a two inch asphalt surface. All street crossings shall comply with accessibility requirements and shall be poured in concrete for a minimum distance of five feet from the closest roadway pavement or curb.
      (2)   Portland cement concrete multi-use paths shall be constructed on a minimum base course of six inches with a four inch concrete surface. All street crossings shall comply with accessibility requirements. Concrete shall be jointed a maximum of ten foot spacing for all control joints and expansion joints shall be placed every 100 feet.
      (3)   Driveway or alley crossings shall be constructed on a minimum base course of eight inches and a four inch asphalt surface or a minimum base course of six inches with a seven inch concrete surface.
   (e)   Approval. Designation of a multi-use path for public use located within any public right-of-way, property held by a unit of government or commission, or within municipal boundaries shall be approved by the Corporate Authorities of the City. At no time shall this chapter be so construed as to allow for asphalt paving of sidewalks or allow for concrete paving in areas in excess of eight feet to be designated as a multi-use path without prior approval of the Corporate Authorities of the City.
