484.08 LOADING ZONES FOR PERSONS WITH DISABILITIES.
   Council shall have authority to establish and recall loading zones for persons with disabilities on any public street located within the City. Loading zones for persons with disabilities may be issued to any natural person who, as determined by a licensed physician:
   (a)   Cannot walk 200 feet without stopping to rest;
   (b)   Cannot walk without the use of, or assistance from, a brace, cane, crutch, another person, prosthetic device, wheelchair or other assistive device;
   (c)   Is restricted by lung disease to such an extent that his or her forced (respiratory) expiratory volume of one second, when measured by spirometry, is less than one liter, or the arterial oxygen tension is less than sixty mm/hg on room air at rest;
   (d)   Uses portable oxygen;
   (e)   Has a cardiac condition to the extent that the person's functional limitations are classified in severity as Class III or Class IV, according to standards set by the American Heart Association; or
   (f)   Is severely limited in the person's ability to walk due to an arthritic, neurological or orthopedic condition.
   (g)   Otherwise qualifies under any local, state or federal law or regulation as disabled.
   Application for a loading zone for persons with disabilities shall be made at the Public Works office. The Public Works Director, in consultation with the Police Chief and the City Legal Counsel, shall determine the anticipated effect upon public safety and whether the application complies with City ordinances. Upon approval of the loading zone application by said City officers, Council shall determine, by resolution, the location of such loading zone, and shall provide that appropriate signs or curb markings indicating the location and length of said loading zone are properly posted. Any application for such loading zone which is denied by said City officers may be appealed to the City Manager.
   All such authorized loading zones shall be renewed annually to determine whether the applicant continues to qualify for such loading zone. Any resolution to establish a loading zone for persons with disabilities may be revoked by Council at any time.
   A loading zone for persons with disabilities shall be for standing vehicles only and not for parking.
