Business loading zone permits may be obtained by compliance with the following:
(a) Any person desiring a business loading zone permit shall make application to the Director of Public Works, setting forth all relevant information, including the location, number of feet and the time desired, the number of deliveries or pickups per day, the type of deliveries or pickups, and the type and ownership of any vehicles dedicated to such pickup or deliveries.
(b) The Director of Public Works may grant or refuse such application if an applicant makes a substantial showing of the factors as listed in Section 484.02 above.
(c) If a permit is approved, the Public Works Director shall issue a permit stating the location, frontage, time limits and any other limitations.
(d) The permit may be withdrawn or further limited by the Director of Public Works at any time for noncompliance.
(e) All signs shall be prepared and lettered by the Division of Streets, and the cost thereof shall be paid by the applicant.
(f) A permit shall continue in force indefinitely, provided that the annual fee is paid until revoked by the Director of Public Works.
(g) The fee for such permit shall be two hundred fifty dollars ($250.00) per year for each twenty linear feet, or portion thereof, for the hours as designated in accordance with the approved permit.
(h) The fee for renewal of a permit shall be the same as the fee for the original issuance.
(i) Fees shall be paid with the original application, subject to refund if denied, and on or before each anniversary date. No refund shall be given if a permit is revoked after initial issuance.
(j) If the provisions of this section or the permit are violated by the holder of the permit or any of his or her employees by use of the loading zone parking space for parking of vehicles of the holder of the permit or his or her employees three times in any fiscal year of the City (May 1 through April 30 of the following year), the loading zone permit shall be revoked and not be renewable upon its expiration on April 30, and the holder shall not be eligible to obtain a loading zone permit for such space until the expiration of twelve months following the April 30 expiration date. The Police Department shall ticket vehicles parked in violation of the provisions of this section. Payment of a fine or forfeiture of a bond for three or more such violations within any one fiscal year shall render the loading zone permit nonrenewable when it expires on April 30.
