1484.22 PRIVATE STREETS.
   (a)   Private streets will be permitted only:
      (1)   As extensions of existing private streets;
      (2)   As part of a development in which additional security is provided for the residents by means of fences, gates and manned gatehouses; or
      (3)   As a secondary means of access and circulation for those condominium developments where each lot fronts on or is served by either an existing or proposed public street.
   (b)   The condominium declaration for any condominium or condominium development which contains private streets shall establish a separate fund for the continued maintenance of such private streets. Assessments for this fund shall be mandatory and not optional on the part of the association.
   (c)   The condominium declaration shall establish the right of the Fire Chief to make whatever inspections he or she feels are necessary on, over and along private streets, and the declaration shall also name a person or officer whose responsibility it shall be to implement fire safety requirements for the use of private streets.
   (d)   The condominium declaration shall establish the right of the City to patrol and otherwise enforce its laws and ordinances over, in and on private streets, as well as the other common areas of the condominium or condominium development, the same as the City would do in, on and over public streets and publicly-owned property.
