1484.04 DEFINITIONS.
   As used in this chapter, unless the context otherwise requires:
   (a)   "Common elements" means all portions of the property except the units.
   (b)   "Declaration" means the instrument by which the property is submitted to the provisions of this chapter, as hereinafter provided, and such declaration as from time to time amended.
   (c)   "Majority" or "majority of unit owners" means the owners of more than fifty percent in the aggregate in interest of the undivided ownership of the common elements. Any specified percentage of the unit owners means such percentage in the aggregate in interest of such undivided ownership.
   (d)   "Parcel" means the lot or lots, tract or tracts of land, described in the declaration, submitted to the provisions of this chapter.
   (e)   "Person" means a natural individual, corporation, partnership, trustee or other legal entity capable of holding title to real property.
   (f)   "Plat" means a plat or plats of survey of the parcel and of all units in the property submitted to the provisions of this chapter, which may consist of a three-dimensional horizontal and vertical delineation of all such units.
   (g)   "Private driveway" means a road or driveway intended solely for the use of the owners and occupiers of dwelling units and their guests and invitees and not intended for use by the public generally.
   (h)   "Private street" means a street or road which is privately owned, not dedicated or owned by the Municipality and not intended for use by the public generally.
   (i)   "Property" means all the land, property and space comprising a parcel, all improvements and structures erected, constructed or contained therein or thereon, including the building and all easements, rights and appurtenances belonging thereto, and all fixtures and equipment intended for the mutual use, benefit or enjoyment of the unit owners, submitted to the provisions of this chapter.
   (j)   "Public street" means a street or road dedicated to the City and platted, constructed and laid out in accordance with all Federal, State and local laws, title to which is held by the City and which is intended for use by the public generally.
   (k)   "Record" means to record in the office of the Recorder of Deeds of the County.
   (l)   "Unit" means a part of the property including one or more rooms, occupying one or more floors or a part or parts thereof, designed and intended for any type of independent use, and having lawful access to a public way.
   (m)   "Unit owner" means the person or persons whose estates or interests, individually or collectively, aggregate fee simple absolute ownership of a unit.
