(a) As used in this chapter, "commercial contractor" means any person, firm or business entity who or which engages in, for profit, the business of providing labor and/or materials for the construction, repair, installation, or maintenance of buildings, accessory structures, or other improvements to real property, including, but not limited to:
(1) Cement, concrete or masonry;
(2) Satellite dishes;
(3) Decks, patios or storage sheds;
(4) New siding and/or replacement windows;
(5) New buildings or structures;
(6) Existing buildings or structures; or
(7) Electrical wiring, fixtures, conduit, and other similar activities, whether within a structure or outdoors;
(8) Other similar activities as determined by the Building Commissioner in accordance with the intent of this chapter.
(b) For the purposes of this chapter, "commercial contractor" shall not include any person providing labor and/or labor and materials for the construction, repair or maintenance of the following:
(1) Residential property owned by the person and occupied as his or her primary residence;
(2) Interior and exterior surfaces by painting, where construction or carpentry is not required;
(3) Yard work consisting of cutting, trimming or cultivating plants, excluding trimming or removal of trees greater than twenty feet in height; or
(4) Other similar activities as determined by the Building Commissioner in accordance with the intent of this chapter.
