1246.05 ZONING OF ANNEXED LAND.
   Ordinances annexing territory to the City of Freeport shall assign a zoning classification to the annexed territory. The classification assigned shall be R-3 One-Family Residence District, unless, within the City boundaries, there are one or more parcels of real estate which are contiguous to, adjacent to, or across any street, alley, river, creek or public way from, any part of the territory annexed, one or more of which have a more restrictive zoning classification than R-3, in which event the annexed territory shall be assigned the most restrictive of the zoning classifications assigned to such other parcels. The classification assigned shall be an R-1 One-Family Residence District, in the event any of the other parcels has such a classification, or if none has an R-1 classification but one or more have an R-2 One-Family Residence District classification, then the annexed territory shall be assigned an R-2 classification. A copy of each proposed annexation ordinance shall be sent to the Planning Commission to conduct a public hearing thereon before its passage by the City Council. If the Planning Commission determines that the zoning classification assigned to the annexed territory (which, under the foregoing provisions of this section, will be either R-1, R-2 or R-3) is not a proper classification, it shall send to the City Council a plan of zoning for the annexed territory. Upon approval of such plan, the City Council shall amend the proposed annexation ordinance to reflect the zoning classification or classifications recommended by the Planning Commission.
