1060.12 CONSTRUCTION DEBRIS; CONTAINERS; COLLECTION.
   (a)   It shall be unlawful for any person, firm or corporation to throw away or otherwise dispose of any waste, rubbish, refuse or debris at a construction site unless such construction waste, rubbish, refuse or debris is stored in a manner and by methods approved by the Building Commissioner. Prior to the demolition, construction or renovation of any building, the Community Development Director shall require submission of an approved plan for the disposal of all construction waste, construction rubbish or refuse or debris, and the deposit of five hundred dollars ($500.00) security, as a precondition for the issuance of a permit for demolition, construction or renovation. The deposit shall be returned at the conclusion of the construction project if all waste, debris, rubbish or refuse has been properly disposed of pursuant to the plan submitted to and approved by the Building Commissioner.
   (b)   Containers for construction waste collection shall not be smaller than fifteen cubic yards in capacity, unless otherwise authorized by the Community Development Director, and shall be of a type commonly used in the refuse collection industry for the storage and collection of large quantities of construction debris and waste. The name of the refuse collection company providing the containers and the telephone number thereof shall be printed clearly on the side of the container. The container shall be kept in good and sanitary condition. A sufficient number of containers shall be maintained on each construction site to accommodate all construction waste, debris, rubbish and refuse therefrom. Access to such containers shall not be across a public curb or road.

   (c)   Construction waste, debris, refuse and rubbish shall be collected and removed from the construction site within twenty-four hours of the time when any required containers are full to capacity. Such containers shall not be allowed to stand on an un-utilized site for longer than fifteen days.
