(a) No person, firm or corporation shall place any dumpster, trash container, trailer, construction trailer or equipment used for construction projects in supplying equipment to a site or removing trash or debris from a site without first obtaining a written permit therefor from the Community & Economic Development Director. Each permit shall cover a single dumpster, trash container, trailer, or equipment, shall be for a period of time not to exceed seven (7) days, shall fix the site or location of the dumpster, trash container, trailer, or equipment, which site or location shall be determined by the Community & Economic Development Director, shall limit the use of the dumpster or trash container to the temporary storage of trash or refuse which is disposable at the City landfill and may contain such other regulations as the Community & Economic Development Director may prescribe regarding the size of the dumpster, container, trailer, or equipment, dimensions, weight limit, covering or camouflage for the dumpster or trash container and coloring or markings on the exterior of the dumpster or trash container. No permit fee shall be charged for the first fourteen (14) days of such placement. Each permit shall be for a period of seven (7) days, and the fee for the permit shall be ten dollars ($10.00) per seven-day increment, assessed after the first fourteen (14) days. Permit fees may be waived by the Community Development Director where the dumpster is necessary for the removal of debris caused by a fire, flood, or natural disaster.
(b) Any person placing a dumpster, trailer, construction trailer or equipment used for construction projects in supplying equipment to a site or removing debris from a site which is placed on any street or public property in the City of Freeport shall, in addition to the requirements set forth in subsection (a) above:
(1) Agree to indemnify the City from damage to third parties.
(2) Agree to be liable to the City for any damage to City property, including, but not limited to pavement, sidewalks, curbs, or trees.
(3) Ensure that the dumpster, container, trailer, or equipment shall have on it reflective markings. These markings will be placed on all corner edges for the full height of the unit. Reflective markings shall consist of red and white all-weather reflective tape and be a minimum of two inches wide. Edges shall mean sides and rear, if attached to a vehicle (four locations), and sides, rear, and front, if stand-alone (eight locations), so it is visible from any side or end.
(4) Ensure that no such dumpster, container, trailer, or equipment shall be located within ten feet of a fire hydrant; nor shall it block access to the site at which it is located, any visible shut-offs in the street, or any vehicular traffic.
Obtaining a City permit for any of the above does not absolve the permittee from IDOT or USDOT regulations, if parked on routes under their jurisdiction.
(c) Any temporary permit granted hereunder may be extended by additional seven-day increments at the discretion of the Community & Economic Development Director. Any requested extension may be denied, or may be made contingent upon additional restrictions or conditions as may be deemed appropriate by the Community & Economic Development Director. The fee for any extended period shall be ten dollars ($10.00), assessed after the first fourteen (14) days that the dumpster is on site. Except as provided for in connection with new construction or a fire or other disaster incidence in subsection (d) of this section, in no event shall any temporary permit be extended to a date which is greater than twenty-eight (28) days after the date the dumpster, container, trailer, or equipment is first located on a property, and in no event shall any dumpster, container, trailer, or equipment remain on a property for more than twenty- eight (28) days in any calendar year, except in strict compliance with the provisions of Section 1272.05 of these Codified Ordinances.
(d) Notwithstanding any contrary provision contained in this chapter, at the sole discretion of the Community Development Director, where there is an active permit for new construction of a primary structure on a site, and for good cause shown, a temporary permit issued under this section may be issued beyond the initial 28-day limit in conjunction with the building permit for a total of six (6) months within a year starting from the date that the permit is issued. The Community Development Director may require, as a condition to the issuance of the extended permit, the relocation or partial screening of the dumpster. No fees shall be required for an extended permit related to new construction of a primary structure.
