(a) Except as otherwise provided in this section, no legal owner or occupant of private property shall throw, deposit or allow to be thrown or deposited any solid waste, hazardous waste, debris, or stable matter outside any structure upon his or her premises. No such legal owner or occupant shall allow such waste to accumulate within any structure upon his or her premises which creates or results in an unsafe or unsanitary condition or a noxious odor.
Nothing in this subsection shall prohibit the accumulation of yard waste generated from the owner's or occupant's premises into a compost pile, provided that the pile is managed so that it does not create a noxious or offensive odor.
(b) Residential household waste receptacles will be provided by the waste contractor and may be stored at the rear of the dwelling unit or they can be placed in a suitable place out of public view when not placed for collection. Toters will be provided by the contractor and will remain with the property regardless of whether the ownership or occupancy of the residence changes. Damaged toter receptacles will be replaced by the contractor. Notwithstanding the foregoing, receptacles damaged due to improper use by the residential dwelling unit owner and/or occupants will be the responsibility of the residential dwelling unit owner and/or occupants to replace. Only receptacles provided by the waste contractor will be used and any other containers left at the curb will result in action by the Code Enforcement Supervisor.
