1024.05 EMERGENCIES.
   (a)   Any person who has on file a bond of the type described in Section 1024.04(b) may make emergency excavations, necessary for preserving health, safety or welfare, without first obtaining a permit. However, such person shall, on the first business day for the Public Works Director's office following the day on which the excavating is begun, make application for a permit.
   (b)   If, in his or her judgment, traffic conditions, the safety or convenience of the traveling public or the public interest require that the excavation work be performed as emergency work, the Public Works Director shall have full power to order, at the time the permit is granted, that a crew of men and adequate facilities be employed by the permittee twenty-four hours a day so that such work may be completed as soon as possible.
