Whoever violates any of the provisions of this chapter shall, upon conviction for a first offense, be fined not less than two hundred dollars ($200.00) nor more than five hundred dollars ($500.00). Upon conviction for a second or subsequent offense within a twelve-month period, the person shall be fined not less than four hundred dollars ($400.00) nor more than five hundred dollars ($500.00).
Fifty percent of all amounts collected as fines under this chapter shall be paid into an account established by the Freeport Police Department for the purpose of funding drug enforcement and prevention activities by law enforcement personnel.
