(a) It shall be unlawful for any person to keep or maintain any dog in the city which has been found to be a vicious dog pursuant to this chapter or the Animal Control Act (510 ILCS 5), and in addition to any violation of this subsection, such keeping shall constitute a nuisance.
(b) If the existence of a nuisance is established, an order may be entered restraining the owner from maintaining such nuisance and ordering that the dog or other animal be humanely dispatched. If such order is entered by an Administrative Hearing Officer, the animal shall not be dispatched until, the time has passed for an appeal of such ruling.
