Whenever any piece of personal property is seized as evidence of a violation of any provision of these Codified Ordinances and is not otherwise ordered disposed of by a court order entered in the prosecutionfor the ordinance violation, the Police Department shall transmit a written notice by certified or registered mail or by personal delivery to the owner of such property, informing him or her that he or she has seven days from the delivery of the notice to pick up the property from the custody of the Police Department. If the owner fails to appear and assume custody of the property, the City's Legal Counsel shall petition the local Circuit Court or the City Ordinance Enforcement Department for an order to auction the property being held. If the person whose property is being held does not appear to reclaim possession of the property being held, the City's Police Department may be ordered to sell the property. Proceeds of the sale of the property, less reimbursement to the City for the reasonable expenses of storage and sale of the property, shall be deposited in the General Corporate Fund of the City.
