240.10 PROMOTIONS.
   Appointments to higher rank, except the Police Chief and the Deputy Chief, shall be made from the next lower rank by examination. All candidates for the position of Corporal must have served in the Department for a minimum of three consecutive years immediately prior to the date of the written examination for such position. All candidates for the position of Sergeant must have served a minimum of one year as Corporal immediately prior to the date of the written examination for such position. All candidates for the position of Lieutenant must have served a minimum of one year as Sergeant immediately prior to the date of the written examination for such position. All candidates for the position of Deputy Chief of Police shall have served a minimum of one year as a Lieutenant or a minimum of three years as a Sergeant immediately prior to the date of written examination for such position.
   The Board of Fire and Police Commissioners shall provide, by its rules and regulations, for promotion within the Department on the basis of ascertained merit and seniority in service and examination. A promotional eligibility list shall be established and maintained by the Board, with appointments to be made from the three highest rated members on such list, without reference to the priority of the time of examination, or from all of the members on such list if there are fewer than three.
