§ 152.021 FILING PROCEDURE, FEE AND DISTRIBUTION.
   (A)   The preliminary plat shall be prepared in accordance with the provisions of these regulations and shall be filed with the Clerk, prior to the initiation of any construction work within the proposed subdivision.
   (B)   The subdivider shall file with the Council or its designee five copies of the preliminary plat and additional copies as the Council may require.
   (C)   At the time of filing a preliminary plat, the subdivider shall pay to the Clerk a fee as set by resolution of the Council to partially defray the expenses incidental to the processing of the plat.
   (D)   The Director of Public Works shall examine the preliminary plat upon filing and shall not accept the plat unless the preliminary plat is in full compliance with the provisions of these regulations as to form and as to the information required to be shown thereon and in the statement required to be furnished therewith.
   (E)   Upon receipt and acceptance of the preliminary plat, accompanying materials and filing fees, the Public Works Director shall transmit copies of the plat and accompanying materials to utility companies and any other agency affected by the subdivisions.
   (F)   The preliminary plat shall be given to the Subdivision Committee with staff recommendations on the proposed subdivision development. A maximum of 20 working days shall be allowed to permit town departments and other agencies to complete their investigation and report their recommendations before submission to the Subdivision Committee. Failure to report within the time specified shall be deemed approval.
   (G)   When all staff and other reports have been received, the Subdivision Committee shall check the plat for conformance with proper design requirements, as required by law, prepare a report incorporating the reports and/or comments from all town departments and other agencies concerned and if the proposed plat is reasonably in conformance, set the matter of hearing before the Council at its next regular meeting. If circumstances warrant it, the Council may set a special meeting.
