§ 94.080 PERMIT REQUIRED.
   (A)   Subject to all other applicable requirements of this section, including time limitations, the Animal Control Officer may in consultation with the Town Manager issue a permit to an applicant to keep in excess of three dogs on the property of an applicant who does not wish to operate a kennel, as defined elsewhere herein. The applicant may receive a written approval from the Animal Control Officer, subject to satisfactorily demonstrating to the Animal Control Officer, of his or her ability to adequately house, care for and maintain a stated number of dogs in an odor-free, sanitary, humane environment. The applicant shall further attest in his or her application that he or she is the owner of the dogs, that he or she does not keep the dogs of others for profit, and that he or she is not keeping the dogs for breeding purposes.
   (B)   A multi-dog permit shall not be issued unless the applicant also:
      (1)   Presents a written consent for keeping of the specified number of dogs signed by all adjacent neighbors to his or her property line;
      (2)   Provides proof of current rabies vaccinations;
      (3)   Provides proof that all dogs six months of age or older have been spayed and neutered;
      (4)   Pays a permit fee. Dog tag fees paid by applicants within the year they have applied for and been granted a multi-dog permit shall be put toward the fee; and
      (5)   Maintains appropriate containment fencing around any yard where dogs inhabit.
   (C)   By applying for a permit hereunder, an applicant consents to inspection by the Animal Control Officer of any part of the premises where dogs may be kept, whereupon access is to be made available for inspection at any reasonable time at the discretion of the Animal Control Officer.
   (D)   The permit shall be renewed annually.
   (E)   The permit provided herein shall not be renewed and may be revoked by the Animal Control Officer if keeping of the dogs in any way violated the nuisance ordinance of the town, including, but not limited to, excessive barking, offensive odors or running at large. The Animal Control Officer shall provide a reasonable period of time, not to exceed 30 days, for the holder of the permit to correct the violations or remove any number of dogs in excess of three.
