§ 94.026 SALE OF UNREDEEMED ANIMALS.
   (A)   All animals, other than dogs, taken up and impounded under the provisions of this subchapter which have not been claimed and for which the fees have not been paid to the town by the owner within five days shall, at the time provided in the notice of sale, be sold by the Police Department at public auction at the place of impoundment to the highest cash bidder. The lowest acceptable bid for any animal shall be equal to the town’s expenses for picking up and boarding the animal. The proceeds from the sale of any animal shall be paid to the Poundmaster who shall deduct therefrom all fees and expenses. The Police Department shall execute a bill of sale in favor of the purchase of the animal and upon payment of the amount of bid shall deliver the bill of sale to the purchaser.
   (B)   The proceeds shall be paid to the owner of the animal if he or she appears and claims it within 30 days after the sale. If no claim is presented within 30 days, the proceeds shall be paid to the General Fund of the town.
   (C)   Any animal not claimed or sold at public auction under the provisions of this subchapter shall be destroyed in a humane manner.
