521.14 HAULING SOLID WASTE.
   (a)   No person, firm or corporation shall engage in the business of collection or disposal of solid waste without having first secured a permit therefor. The annual fee of such permit shall be fifty dollars ($50.00) for each vehicle used. Licenses shall expire annually on the last day of December of each year.
   (b)   Applications for such permits shall be made to the Village Clerk and shall be referred by the Village Clerk to Council. No permit shall be issued except on order of the Council. All applications shall contain the following information:
      (1)   The name of the person, firm or corporation making application.
      (2)   If a corporation, the names and addresses of all those persons having an interest in excess of ten percent (10%) thereof.
      (3)   If a partnership, the names and addresses of any and all partners.
      (4)   The address of the principal business office of each applicant.
      (5)   The telephone number of each such applicant.
      (6)   A fee schedule which shall remain in full force and effect during the period the permit shall be in force.
   (c)   Any vehicle used by such solid waste hauler in his business shall be leak-proof and equipped with tight covers for such portions as are used for the transportation of refuse. Hauling of furniture, white goods, tree limbs, building demolition material and industrial waste must be done in suitable vehicle for safety and to prevent refuse from blowing or falling from the vehicle.
   (d)   No solid waste hauler shall dispose of or unload any refuse in any place in the Village limits or within one mile thereof.
   (e)   All applicants shall have in force at the time of application and shall maintain in force for and during the term of the permit a policy of insurance as follows:
      (1)   Liability insurance: Not less than one hundred thousand dollars ($100,000) for each individual injured; not less than three hundred thousand dollars ($300,000) for each occurrence.
      (2)   Property damage: Not less than fifty thousand dollars ($50,000).
   All applications shall be accompanied by a certificate of insurance in not less than the above amounts and the Village Clerk shall cause the certificate to be filed with the application.
   (f)   All persons, firms and corporation holding permits hereunder shall fully and completely comply with any and all laws of the State, including but not limited to, the Workers’ Compensation and unemployment compensation laws.
   (g)   Whoever violates any provision of this section shall be fined for a first offense not more than fifty dollars ($50.00); for a second offense within one year thereafter, not less than ten dollars ($10.00) nor more than one hundred dollars ($100.00), or imprisoned for not more than ten days, or both; for a third or subsequent offense, within one year after the first offense, not less than twenty-five dollars ($25.00) nor more than two hundred dollars ($200.00), or imprisoned not more than thirty days, or both.
