521.12 OPENING BURNING.
   (a)   Restrictions. No person shall cause, suffer, allow or permit open burning of refuse, trade waste, salvage waste, agricultural waste or other combustible material within the Village except as may be allowed in compliance with subsection (b) hereof.
   (b)   Exceptions.  
      (1)   Outdoor burning in connection with the preparation of food.
      (2)   Campfires and fires used solely for recreational purposes or ceremonial purposes.
      (3)   Fires set for purposes of training of public or private firefighting personnel, with the approval of the Chief of the Fire Department.
      (4)   Fires set or required by public officers for the abatement of nuisances and which are necessary in carrying out public health functions, with the approval of the Director of the Ohio EPA.

      (5)   The burning of trees, brush, shrubs in a properly designated, operated and maintained open pit incinerator is permitted on the premises from which the trees, brush, shrubs originated if approval prior to burning has been granted by the State Director, Ohio Environmental Protection Agency, P.O. Box 104, 361 East Broad Street, Columbus, Ohio 43215.

      (6)   Any open burning permitted under provisions of subsection (b)(1) to (5) hereof shall begin only between three hours after sunrise and three hours before sunset and in addition, fuel may not be intentionally added to fires at times outside the limits stated herein.
   (c)   Penalty. Violation of this section shall be considered as a minor misdemeanor for the first offense, a fourth degree misdemeanor for second and third offenses, and a third degree misdemeanor for each subsequent violation. (Ord. 1985-22. Passed 9-16-85.)
