3-7-6: INELIGIBILITY FOR LICENSE:
   A.   All establishments, including any business operating at the effective date hereof, operating or intending to operate an adult oriented business shall be prohibited if the license fee required by this chapter has not been paid.
   B.   1. All establishments, including any business operating at the effective date hereof, operating or intending to operate an adult oriented business shall be prohibited if an applicant has been convicted of a crime involving any of the following offenses: (Ord. 124, 7-6-2004)
         a.   Any sex crimes as defined by Minnesota statutes sections 609.293 through 609.352, inclusive, or as defined by any ordinance or statute in conformity therewith. (Ord. 124, 7-6-2004; amd. 2008 Code)
         b.   Any obscenity crime as defined by Minnesota statutes sections 617.23 through 617.299, inclusive, or as defined by any ordinance or statute in conformity therewith for which:
            (1)   Less than two (2) years have elapsed since the date of conviction or the date of release from confinement imposed for the conviction, whichever is the later date, if the conviction is of a misdemeanor offense;
            (2)   Less than five (5) years have elapsed since the date of the last conviction or the date of release from confinement for the conviction, whichever is the later date, if the conviction is a felony offense; or
            (3)   Less than five (5) years have elapsed since the date of the last conviction or the date of release from confinement for the last conviction, whichever is the later date, if the conviction is of two (2) or more misdemeanor offenses or combination of misdemeanor offenses occurring within any twenty four (24) month period.
      2.   The fact that a conviction is being appealed shall have no effect on disqualification of the applicant's spouse.
      3.   An applicant who has been convicted of an offense listed in subsection B1 of this section may qualify for an adult oriented business license only when the time period required by subsection B1 of this section has elapsed. (Ord. 124, 7-6-2004)
