§ 152.072 FENCES; PROPERTY BARRIERS.
   (A)   A building permit shall be required for the construction or reconstruction of all fences or property barriers.
   (B)   A property owner may construct a fence on the owner’s property only in accordance with the following specifications.
      (1)   (a)   The fence must be constructed using maintenance-free material having a life span of 20 years or more.
         (b)   Maintenance-free material shall include chain-link, stone or concrete wall, vinyl, PVC and pressure treated lumber.
         (c)   Rough-cut lumber or other untreated wood material is not deemed maintenance-free.
      (2)   Line fences may be erected on the property line, but shall not encroach upon the property of another.
      (3)   No fence shall exceed a height of eight feet.
      (4)   No fence shall be erected within three feet of any village-maintained sidewalk and the first eight feet of fence on either side of the owner’s driveway, alley or sidewalk shall not exceed a height of four feet.
      (5)   No fence fronting a public street or highway, and running approximately parallel thereto, shall exceed four feet in height.
      (6)   Any fence running approximately perpendicular to a publicly maintained sidewalk, street or highway shall have a maximum height of four feet for the first eight feet of the fence in closest proximity to the sidewalk, street or highway.
      (7)   Shrubs and other trees placed as a continuous barrier shall conform in height and distance to the standards set forth above, except the center of the shrub or plant shall be placed from any publicly-maintained sidewalk at a distance of three feet plus one-half the mature diameter of the shrub or plant.
