§ 152.048 REPAIRS AND ALTERATIONS; EXTENSION; RESTORATION.
   (A)   Normal maintenance of a non-conforming building is permitted. However, the building may not be reconstructed or structurally altered during its life to an extent exceeding in aggregate cost 25% of the assessed value of the building unless changed to a conforming use.

   (B)   A non-conforming use shall not be extended, but the extension of a lawful use to any portion of a non-conforming building, designed or manifestly arranged for the use, which existed prior to the enactment of this chapter shall not be deemed the extension of the nonconforming use.

   (C)   No building damaged by fire or other causes to the extent of more than 50% of its real value, computed through the use of the current assessed valuation and equalization rate, shall be repaired or rebuilt except in conformity with the regulations of this chapter. Application for a permit to rebuild or restore the damaged portion of any non-conforming building, as described in this section, shall be filed within six months of the day of the damage. If approved, the permit for the rebuilding or restoration shall be granted for a period of two years and shall not be renewable.
