(A) If the Village Board of Trustees determines by resolution that it is in the best interests of the village to do so, the provisions of § 30.03 above may be waived with respect to an applicant or applicants for a particular title or position in accordance with the following standards:
(1) Lack of qualified applicants. The requirement of residency may be waived in those instances where the employer has difficulty hiring the most qualified person because of the residency requirement; or
(2) Necessity for nonresidency. The requirement of residency may be waived in those instances where it is determined that residency is not a material consideration for the title or position.
(B) A copy of any resolution adopted in accordance with this provision shall be placed in the personnel file of the affected individual and a copy thereof shall be mailed or delivered to the individual.
