(A) The employee shall be sent a notice of the hearing date at least 15 days prior to the hearing. The hearing record and the determination of the supervisor as to whether the employee is a nonresident or resident shall be referred to the Mayor for review and decision.
(B) Should the Mayor decide that an employee is a nonresident in violation of § 30.03 above, the employee shall be dismissed in accordance with any statutory or contractual procedure applicable to the employee under the circumstances.
(C) Upon re-establishing residency, an individual having been dismissed may apply for reinstatement and shall be reinstated if the position is vacant.
