§ 131.12 RECEIVING A COMMERCIAL BRIBE.
   (A)   A person is guilty of receiving a commercial bribe when:
      (1)   As an employer or agent, and without the consent of his or her employer or principal, he or she knowingly solicits, accepts or agrees to accept any benefit from another person upon an agreement or understanding that the benefit will influence his or her conduct contrary to his or her employer’s or principal’s best interest; or
      (2)   As a fiduciary, and without the consent of his or her beneficiary, he or she knowingly solicits, accepts or agrees to accept any benefit from another person upon an agreement or understanding that the benefit will influence his or her conduct contrary to his or her fiduciary obligation.
   (B)   Receiving a commercial bribe is a Class A misdemeanor.
