(A) A public servant is guilty of official misconduct in the second degree when he or she knowingly:
(1) Commits an act relating to his or her office which constitutes an unauthorized exercise of his or her official functions;
(2) Refrains from performing a duty imposed upon him or her by law or clearly inherent in the nature of his or her office; or
(3) Violates any statute or lawfully adopted rule or regulation relating to his or her office.
(B) Official misconduct in the second degree is a Class B misdemeanor.
