(A) Any person desiring to disturb, cut or dig into or under, or otherwise tamper with the surface of any city road within the county, both inside and outside the city limits, shall first make application in writing to the city, which application shall be filed at least seven days before the applicant may be authorized to proceeds Such application shall include a description of the applicant’s proposed activity as well as a description of the work applicant intends to perform to restore or protect the surface of the affected city road.
(B) No permit shall be issued unless the following conditions are met.
(1) The plans or work applicant intends to perform to protect or restore the surface of the affected city road must be in compliance with the Approved Methods of Surface Restoration and, Open Trench Pipe Installation as adopted by the City Commission, and attached hereto.
(2) The applicant must deposit with the city bond in the penal sum of $5,000, with good surety, or in lieu thereof cash bond of equal amount, such bond to insure and be conditioned that applicant will protect or restore the surface of the affected city road in accordance with the Approved Methods of Surface Restoration and Open Trench Pipe Installation as adopted by the City Commission.
(3) The applicant’s proposed activity must not pose a threat to the health or safety of other persons.
