§ 50.02 WATER USAGE DURING DROUGHT CONDITIONS.
   (A)   Purpose of section. When conditions throughout the City Drinking Water District create an increased likelihood that the anticipated demands cannot be met and/or the water source is subject to harm, the City Commission will issue a resolution stating that conservation of water is necessary and/or mandatory. When the resolution is issued, the City Commission will set the level of drought condition, as set forth below, which the citizens of the city are required to follow. The resolution shall state the level of water conservation which is in effect consistent with the levels set forth in this section, the reasons why said level is in effect, and the length of time that the water consumption restriction will be in effect. This section defines the specific levels of water conservation, states when they shall come into effect, and recites the restrictions placed on consumers when the restrictions are in effect.
   (B)   Drought levels. There are four levels of water conservation restrictions as follows:
      (1)   Level 1. When a Level 1 water shortage resolution is passed, all city water users are encouraged to reduce their water use and to conserve water to the maximum extent possible on a voluntary basis. These voluntary restrictions shall not be used to limit any activities designed to prevent the spread of fire or to save property from being destroyed by fire. Once the resolution passes, this restriction shall take effect immediately.
      (2)   Level 2. When a resolution is passed declaring a Level 2 water shortage, all of the city water users and/or persons and/or entities connected to the city water distribution system shall be required to reduce their water use and to conserve water to the maximum extent possible. These mandatory restrictions shall not be used to limit any activities designed to prevent the spread of fire or to save property from being destroyed by fire. Once the resolution setting this level of conservation passes, this section shall take effect immediately and shall include, but not be limited to, the following:
         (a)   Residential. Watering lawns, washing vehicles, watering gardens and filling swimming pool will be limited to the use by even numbered street addresses on the days of Monday, Wednesday and Friday, while odd numbered street addresses will be limited to the days of Tuesday, Thursday and Saturday only. For example: John Doe lives at 220 East Cedar. Therefore, John Doe can only water his lawn on Monday, Wednesday and Friday until further notice.
         (b)   Golf courses. Irrigation of greens and tees should be reduced and performed during non-daylight hours. Irrigation of fairways, roughs and non-playing areas on the first nine holes on the course (or only nine holes in the event the course is only a nine hole course) should be restricted to non-daylight hours on Wednesday and Friday. Irrigation of fairways, roughs and non-playing areas on the last nine holes of the course should be restricted to non-daylight hours on Thursday and Saturday. Applications of fertilizer, herbicides and pesticides should be performed no more than twice a week.
         (c)   Water-based recreation. Existing facilities shall not be refilled, except for makeup water. Water based recreation should be voluntarily reduced.
      (3)   Level 3. When a resolution is passed declaring a Level 3 water shortage, all of the city water users and/or persons and/or entities connected to the city water distribution system shall be required to adhere to the following plan. These restrictions shall not be used to limit any activities designed to prevent the spread of fire or to save property from being destroyed by fire. Once the resolution passes, this section shall take effect immediately and shall include, but not be limited to:
         (a)   Household. Watering lawns, washing vehicles, watering gardens and filling swimming pools shall not be allowed for any reason until further notice.
         (b)   Golf courses. Irrigation of greens, tees, fairways, roughs and non-playing areas shall not be allowed until further notice. Also applications of fertilizer, herbicides and pesticides will not be allowed until further notice.
         (c)   Water-based recreation. Water based recreation shall not be allowed and existing facilities will not be allowed to refill until further notice.
      (4)   Level 4. If the above listed efforts are insufficient to protect the water source, additional measures will be imposed by resolution by the City Commission. These measures may include emergency water rate increases, and curtailment of water to business and industry.
   (C)   Table. For purposes of this section, a resolution setting water restriction levels will be implemented in accordance with the following table:
