§ 32.26 CITY MANAGER.
   (A)   There is hereby created in the city the office of “City Manager”.
   (B)   The City Manager shall be the chief executive officer of the city and exercise those executive powers and duties delegated to him or her by ordinance and statute. He or she shall enforce the City Manager plan, city ordinances and all applicable statutes. Subject to approval of the City Commission, the City Manager shall promulgate procedures to ensure orderly administration of the functions of city government and compliance with statutes or ordinances. Any delegation of the City Manager’s duties or responsibilities to subordinate officers and employees shall be made by ordinance, except that all bonds, notes, contracts and written obligations of the city according to ordinance or resolution shall be made and executed by the Mayor on behalf of the city.
   (C)   The City Manager shall have all duties set forth in KRS 83A.150, including, but not limited to:
      (1)   Being responsible to the Board for the proper administration of all duties imposed upon him or her by ordinance;
      (2)   Recommending to the Board, subject to any statute, ordinance or contract which relates to the appointment, tenure or removal of any employee, the appointment and when necessary for the good of the service, the removal of subordinate employees and officers of the city; provided, however, no officer or employee of the city shall be appointed or removed except through action by the Board;
      (3)   Preparing the budget and submitting it to the Board and being responsible for its administration after adoption;
      (4)   Preparing and submitting to the Board as of the end of each fiscal year a complete report on the finances and administrative activities of the city for the preceding year;
      (5)   Keeping the Board advised of the financial condition and future needs of the city and making recommendations as he deems desirable;
      (6)   Maintaining a liaison with related units of local government respecting inter-local contracting and joint activities;
      (7)   Supervising all departments of city government and the conduct of all city officers and employees under his or her jurisdiction and requiring each department to make reports to him or her as required by ordinance or as he or she deems desirable; and
      (8)   Performing other duties required of city executive authorities by statute or required of him or her by the Board not inconsistent with KRS 83A.150.
   (D)   The City Manager shall exercise leadership in implementing a fair system of effective personnel administration and shall administer the provisions of the city’s Personnel Policies and Procedures, Position Classification Plan and Employee Compensation Plan as previously adopted. All employees shall perform their duties subject to the direction of the City Manager or his or her designee.
   (E)   The City Manager shall attend all meetings of the Commission and shall keep the Commission informed of the affairs of the city and shall recommend to the Commission such actions as may be necessary or expedient for the welfare of the city.
   (F)   The City Manager shall examine all proposed contracts to which the city may be a party and it shall be the duty of the City Manager to see that all terms of any contract to which the city is a party are fully performed to the extent of the city’s legal obligation thereunder. The City Manager shall confer with the City Attorney concerning legal matters.
   (G)   The City Manager shall be the general purchasing agent for the city, and except where specific provisions to the contrary are made by law or by the Commission, he or she shall make all purchases of supplies, materials and equipment authorized by the City Commission in the manner prescribed by and subject to the limitations imposed by law.
   (H)   The City Manager shall be responsible for the preparation of all tax levy ordinances for passage in order to collect all taxes in a timely fashion.
   (I)   The City Manager shall keep current accounts showing at all times the fiscal condition of the city, including the current and anticipated expenses, appropriations, cash on hand and anticipated revenues of all municipal funds and accounts, and he or she shall see to the collection of all money due the municipality.
   (J)   The City Manager shall keep a current inventory showing all real and personal property of the city and its location, and shall be responsible for the oversight of the care and custody of all such property, including equipment, buildings, parks and all other city property, which is not by law assigned to some other officer or governmental body for care and control.
   (K)   The City Manager shall oversee the publication of all notices, ordinances or other documents required by law to be published, and to prepare or cause to be prepared, all reports which the city or any of the officials thereof are required by law to prepare.
   (L)   The City Manager shall prepare and have custody of municipal records required by law to be kept by the city and not by a specific officer. Where the law makes it the duty of a specific officer to keep or maintain records, the City Manager shall make available to such officer all necessary clerical assistance for the preparation of such records and shall make available a place for the custody of such records. In compliance herewith, the City Manager shall make available to the Clerk stenographical clerical assistance necessary for the preparation of the journal of commissioner meetings and the record of ordinances and all other documents which by law the Clerk is required to keep.
   (M)   Where the law requires or provides for certification of any records or documents by any officer of the city, the City Manager shall cause such records or documents to be properly prepared and presented to such officer for his or her signature.
   (N)   The City Manager shall be ex-officio City Collector and City Comptroller, unless such offices or either of them are duly filled by appointment and he or she shall perform the duties of each such office in the absence of such appointment to either of them.
   (O)   The City Manager shall cause to be kept a complete set of maps and plats showing the location of all city utilities, and other municipal properties, all streets and other public places and all lots or parcels of land subdivided according to law.
   (P)   The City Manager shall maintain an office in the City Hall and shall devote his or her full time in the performance of his or her duties as may be required by the City Commission. In the event that the City Manager shall be absent from the city or incapacitated from performing the duties of his or her position, the Mayor shall act as City Manager during such absence or incapacity.
   (Q)   The City Manager shall be selected by the Commission based on the level of his or her qualifications in the following general areas: training/experience; economic development; knowledge of police; knowledge of grants and related subjects; knowledge of water and sewer service; and budget/finance. In addition, he or she must have a bachelor’s degree in a field of study related to city management and may be required to have such other executive and administrative qualifications as may be established by the Commission from time to time.
   (R)   The City Manager shall be paid an annual salary to be fixed by majority vote of the City Commission as part of the annual budgetary process. In addition, the City Manager shall be entitled to such fringe benefits as are offered to all other city employees.
   (S)   The City Manager shall be appointed for an indefinite term and may be removed only by a majority of all Board members subject to the procedure set forth in KRS 83A.150(8).
