(A) Establishment. A Department of Sanitation is established, and the Mayor is directed to appoint a member of the Commission as Commissioner of this Department. The Commissioner shall serve for such term as the Mayor shall designate.
(B) Establishment of municipally operated garbage disposal system.
(1) A municipally operated garbage disposal system is established which shall be regulated by and under the control of the Department of Sanitation.
(2) The garbage disposal system shall be commenced and become effective on April 1, 1970.
(C) Department of Sanitation shall fix rates and adopt regulations.
(1) The Department of Sanitation shall fix such rates and adopt such regulations for collection of garbage which it deems reasonable and in the best interest of the residents under its jurisdiction and shall fix such rates and adopt such regulations which it deems reasonable and in the best interest of the users of the city water system who reside outside the city limits. These rates and regulations may be changed from time to time in the event circumstances arise indicating the advisability of a change.
(2) The rates and regulations, including scheduled routes, upon being fixed by the Department of Sanitation, shall be published in the Franklin Favorite, a weekly newspaper of general wide circulation in the city. This publication shall constitute notice to the public to be served. Any future changes shall likewise be published.
