§ 31.01 ELECTRIC PLANT BOARD.
   (A)   The city declares and records its desire and intention to accept and operate under the provisions of Chapter 18 of the Act, of the 1942 General Assembly of Kentucky (KRS 96.550) and hereby accepts and agrees to all of the provisions thereof as now constituted and as they may from time to time be amended by the Acts of the General Assembly of Kentucky.
   (B)   The Board of Directors of the Electric Plant Board of the city shall be comprised of five members, and no person shall be appointed unless he or she has resided within the city for at least two years preceding the date of his or her appointment, nor unless he or she is a property owner of the city, nor unless he or she is otherwise qualified under KRS 96.740.
   (C)   The four regular members shall be appointed by the Mayor of the city, subject to the approval of the City Commission, for a term of four years each, and no member may serve more than two successive four-year terms, at the end of which period any such person shall be ineligible for reappointment until a two-year period has expired from the date of his or her last (second) four-year term. All present members appointed to the Board of Directors shall complete their respective terms as appointed and are eligible for one additional four-year term if reappointed by the City Commission.
      (1)   The fifth member shall be one of the members of the City Commission as designated by the Mayor, with the approval of the City Commission, and such member’s term shall be fixed by the Mayor, but no longer than his or her term of office as a member of the City Commission.
      (2)   If any member resigns or for any reason ceases to be a member of the Board before the expiration of his or her term, the Mayor, with the approval of the City Commission, shall appoint a new member to complete such member’s unexpired term, and the provisions as set forth above shall apply.
   (D)   Upon the appointment of the Board, the name shall be the “Electric Plant Board of the City”. The Board shall have the general supervision, improvement, operation and maintenance of an electric plant for the city, and shall have all the powers, authority, duties and responsibilities of boards of public utilities created, appointed and qualified under and pursuant to the provisions of the Act of the General Assembly referred to in division (A) above.
   (E)   The city shall not be liable for the payment of any salary or compensation of any of the members of the Board of Public Utilities, or for the payment of the salary or compensation or expenses of any person employed by the boards all of which salaries, compensation and expenses and any liabilities of whatsoever kind of character incurred by the Board, or any officer or employee thereof, shall be payable solely and only out of revenues obtained by the Board under the provisions of the Act referred to in division (A) above.
