10-2-2-4: NOTIFICATION OF SURROUNDING PROPERTY OWNERS:
In order to allow property owners surrounding the proposed site to provide information helpful to a proper review of the preliminary plan, one or both of the following activities shall be undertaken as decided by the plan commission:
   A.   The applicant shall, not less than ten (10) days and not more than thirty (30) days prior to the date of said meeting, serve written notice either in person or by certified mail to the last known taxpayers as reflected in the county records of all property within two hundred fifty feet (250') in each direction of the location for which the subdivision is requested; provided the number of feet occupied by all public roads, streets, alleys, rivers, creeks, schools, parks and other public ways shall be excluded in computing the two hundred fifty foot (250') requirement. The notices herein required shall contain the address of the location for which the preliminary plat of subdivision is requested, a brief statement of the nature of the request, the name and the address of the legal and beneficial owner of the property, and time and date on which said meeting shall be held. If, after a bona fide effort to determine such by the applicant, the owner of the property on which the notice is served cannot be found at his last known address or the mail notice is returned because the owner cannot be found, the notice requirements of this section shall be deemed satisfied. The applicant shall furnish, at the time of said meeting, a written statement certifying that he has complied with the requirements of this subsection. Attached to the written statement shall be a copy of the notice sent and a list of all property owners notified in accordance with the above. Also attached shall be the returned receipts of those notices delivered and those notices which were undeliverable by the post office; and/or
   B.   The village shall publish, in a newspaper of general circulation, notice of the time and place where the public may comment on the preliminary plan. The notice shall be published in said newspaper not less than ten (10) days prior to the public meeting where comments may be given. (Ord. 610, 4-9-2001)
