A. Permits Required:
1. Excavations: It shall be unlawful to make or cause to be made any excavation in or across or to tunnel under the curb, gutter or roadway of any street or sidewalk or any village property within the corporate limits of the village without having first secured a permit therefor from the village clerk.
2. Tree Trimming: It shall be unlawful to trim trees, parts of which may fall on village sidewalks, streets or other village property without first having secured a permit therefor from the village clerk. (Ord. 397B, 11-2-1959)
B. Approval Required: No permit shall be issued except on approval of a member of the committee of streets and alleys or on order of the president of the board of trustees or the chief of police.
C. Bond And Insurance: Each application shall be accompanied by a cash bond or a bond with a corporate surety or such surety as shall be approved by a member of the committee or the village president or the chief of police. The bond shall be in such amount, not less than ten dollars ($10.00) nor more than one thousand dollars ($1,000.00), as may be determined and approved by the member of the committee or the village president or the chief of police, and shall be conditioned to indemnify the village for any liability, loss or damage resulting from the work undertaken or the manner of doing the same and for the restoration of the street, alley, sidewalk, curb or gutter or other village property as hereinafter provided. In addition, each such applicant shall furnish evidence acceptable to the member of the committee or the village president or the chief of police of satisfactory public liability insurance in limits of at least twenty five thousand dollars ($25,000.00) for injuries to each person, fifty thousand dollars ($50,000.00) for injuries in each accident and five thousand dollars ($5,000.00) for damage to property in each accident, covering all damages occasioned by or in any manner resulting from such work.
