5-2-4: CURFEW FOR MINORS 1 :
   A.   Age And Hour Restrictions: It shall be unlawful for any person less than eighteen (18) years of age to be present upon any public assembly, building, place, street, or highway in the village at the following times unless accompanied by a parent, legal guardian or other responsible companion at least eighteen (18) years of age unless engaged in a business or occupation which the laws of the state authorize a person less than eighteen (18) years of age to perform:
Between 12:01 A.M. and 6:00 A.M. on Saturday;
Between 12:01 A.M. and 6:00 A.M. on Sunday; and
Between 11:00 P.M. on Sunday to Thursday, inclusive, and 6:00 A.M. on the following day.
   B.   Standard Time: Time referred to herein is based upon the prevailing standard of time, whether Central Standard Time or Central daylight saving time, generally observed at that hour by the public in the village, prima facie the time then observed in the village hall.
   C.   Detaining Child: Every member of the police force, while on duty, is hereby authorized to detain any such minor wilfully violating the provisions of subsection A of this section until the parent or guardian of the child shall take him or her into custody, but such officer shall immediately upon taking custody of such child communicate with the parent or guardian or other person having custody of such minor.
   D.   Permitting Child To Violate Curfew: It shall be unlawful for anyone having the legal care and custody of any person as described above to allow or permit such person to go or be upon any public street, alley or other public place in the village in the nighttime as restricted in subsection A of this section, except in case of necessity.
