§ 153.055  TAKINGS.
   (A)   This Development Code was written with great care to attempt to balance the need to protect the natural assets, agricultural industry, and environmental concerns with the private property rights of landowners.
   (B)   If any citizen believes that a county decision has affected a taking of property without compensation as prohibited by the Fifth Amendment to the U.S. Constitution, the following review procedure is the first step which should be taken to ascertain whether or not a taking has occurred.
      (1)   The citizen shall file a written request for review with the PZA.
      (2)   The PZA shall schedule a meeting with the citizen, the PZA, the county attorney, and the Chair person of the Commission and/or Board that has rendered the questioned decision within 15 days to review the decision. A takings checklist prepared by the state’s Attorney General is included in this Development Code as Appendix N.
      (3)   The included parties shall review the claim and report its findings to the Commission and/or Board at the next regularly scheduled meeting.
