§ 152.126  ACTION.
   (A)   Commission recommendation. The Commission shall review the request and all agencies response and make a recommendation to the Commission for either approval, conditional approval, or denial.
   (B)   Commission action.
      (1)   (a)   When considering an application for vacation procedures, the Commission shall establish a date for a public hearing and give such public notice as required by law.
         (b)   The Commission may approve, deny, or modify the application.
         (c)   Whenever public rights-of-way or lands are vacated, the Commission shall provide adjacent property owners with a quit claim deed for the vacated rights-of-way in such proportions as are prescribed by law; however, with regard to the vacation of county roads, state statutory law shall prevail over the terms and conditions hereof.
      (2)   (a)   When considering an application for dedication procedures the Commission may approve, deny, or modify the application.
         (b)   When a dedication is approved, the required street improvements shall be constructed or a bond furnished assuring the construction prior to acceptance of the dedication of land.
         (c)   The owner shall furnish to the Commission a deed describing and conveying such lands to be recorded with the County Recorder.
