(A) ACOs (“existing ACOs”) will be allowed to expand to 1,000 animal units without complying with this subchapter, subject to an annual limit of 5% growth after reaching 1,000 animal units. The expansion of ACOs over 1,000 animal units existing on the date of this subchapter shall be limited to a total of 40% growth. Provided, however, that if an existing ACO which would otherwise be limited by a provision of this division (A) has sufficient land to achieve seven animal units per acre, such existing ACO shall not be bound by the percentage growth limitations.
(B) Animals not designated in the animal unit chart are not exempt.
